Art. 1 General conditions for using the website

The company that manages the website https://www.inatech-shop.ro/ is SC INATECH PACKAGING S.R.L., hereinafter referred to as INATECH PACKAGING, registered with the Trade Register under no. J2012002842230 and having the Unique Registration Code: RO27835240, Tel.: +40.214.480.358; e-mail: [email protected]. The use of this website implies acceptance of the terms and conditions below. We recommend that you read them carefully. INATECH PACKAGING reserves the right to modify these provisions without further notice. The latest version can be found by accessing the “Terms and Conditions” page.

SC INATECH PACKAGING S.R.L. launched the website https://www.inatech-shop.ro in order to inform all its customers. Your use of this website is subject to compliance with the general access and usage conditions detailed below (“General Conditions”), as well as with all applicable laws. When you access, browse and use the website, you implicitly and unconditionally accept the General Conditions, which prevail over any other agreement you may have with SC INATECH PACKAGING S.R.L., with all members of its commercial network or with only some of them.

Art. 2 How to order online

After adding the products available online on the https://www.inatech-shop.ro/ platform to the shopping cart, information regarding identification and billing details, the desired payment method and the delivery method is required. It is also possible to place an order without creating a user account.

After reading these terms and conditions, the “I agree to the Terms and Conditions” box must be checked and the order must be submitted with the obligation to pay. Depending on the chosen payment method — bank transfer, cash on delivery or online bank card payment operated by MobilPay — you will receive an order confirmation email and a payment confirmation email. The moment of conclusion of the distance contract with an individual, respectively the moment of conclusion of the sales contract with a legal entity, is the moment when the consumer receives the confirmation message regarding their order.

Art. 3 Delivery of goods and services at a distance

The orders accepted by INATECH PACKAGING and that will be fulfilled are orders sent online through the order form, orders received by e-mail and by phone, provided they contain at least the following: the consumer’s name, address, telephone number and e-mail address.

INATECH PACKAGING must fulfil the orders received through this website within a maximum of 30 days from the order date, except where the parties have agreed otherwise. If INATECH PACKAGING cannot execute the contract/delivery because the product or service is not available, it must inform the consumer of this unavailability within 1-3 business days, and any amounts paid in advance by the consumer must be refunded within a maximum of 30 days.

Delivery times may change in exceptional situations that cannot be controlled and could not reasonably have been foreseen or avoided, when the workload is high, including, but not limited to, Easter holidays, Christmas, Black Friday, epidemics, pandemics and natural disasters.

INATECH PACKAGING may deliver to the consumer a product or service of equivalent quality and price to the one requested only with the consumer’s written or verbal consent. In this case, the return costs for these products shall be borne by INATECH PACKAGING.

INATECH PACKAGING will not deliver products or services without a prior order from the consumer.

INATECH PACKAGING delivers goods only within Romania.

Art. 4 Conditions and procedures for returns or withdrawal from ordered products

If you are not satisfied with the purchased products, you may return them under the following conditions:

– Send a notification by e-mail to [email protected], stating the reason for your dissatisfaction.

The consumer has the right to notify the trader in writing that they withdraw from the purchase, without penalties and without providing a reason, within 10 business days from receiving the product.

– We will respond to any complaint within 2-3 business days and, if there is no other solution, we will confirm acceptance of the product return;

– We accept returns only for products in their original packaging and in perfect presentation condition, without being bent, torn or broken. We accept the return of defective/damaged products only if accompanied by a signed declaration under the customer’s own responsibility stating that the defects occurred due to causes other than negligence or incorrect handling.

We do NOT accept the return of products made according to the consumer’s specifications, unsealed products, distinctly personalized products, or products which, by their nature, cannot be returned or may deteriorate quickly.

– Courier transport costs for sending the parcel to the INATECH PACKAGING headquarters shall be borne by you. INATECH PACKAGING has the obligation, within 30 days from receiving the returned products, to refund their value through a payment method agreed by both parties – generally by transferring the value of the products to the bank account of the individual/legal entity listed as the “buyer” on the tax invoice.

Art. 5 Intellectual property rights

Art. 5.1 Copyright and/or rights over industrial designs and models

SC INATECH PACKAGING S.R.L. is considered the author of this website. Photographs, texts, slogans, drawings, images, animated sequences with or without sound, as well as all works integrated into this website are the property of INATECH PACKAGING or of third parties who have authorized SC INATECH PACKAGING S.R.L. to use them.

The product models presented on this website are protected in accordance with the legal provisions regarding copyright and related rights, as well as the protection of industrial designs and models.

Paper or digital reproductions of the above-mentioned website and of the works and installation models reproduced there are authorized provided that they are intended for strictly personal use, excluding any use for advertising and/or commercial and/or informational purposes, so as to comply with the legal provisions regarding intellectual property.

Except for the provisions above, any reproduction, presentation, use or partial or full modification of the website, regardless of the process or medium used, of the various works and installation models that compose it, without prior authorization from SC INATECH PACKAGING S.R.L., is strictly prohibited and constitutes the offence of counterfeiting, punishable according to the legislation in force.

The name SC INATECH PACKAGING S.R.L., the SC INATECH PACKAGING S.R.L. logo, the names of products in the SC INATECH PACKAGING S.R.L. range, as well as the products and services associated with them, are registered trademarks of SC INATECH PACKAGING S.R.L.

Other trademarks are also mentioned; they are theoretically identified by a capital letter. These are used by SC INATECH PACKAGING S.R.L. either with the authorization of the owner or simply as an indication of products or services offered by SC INATECH PACKAGING S.R.L.

The reproduction, imitation, use or application of these trademarks without prior authorization from SC INATECH PACKAGING S.R.L. or from the respective owners constitutes the offence of counterfeiting, punishable according to the laws in force.

Art. 10 Limitation of liability

The user uses the website at their own risk. Under no circumstances shall SC INATECH PACKAGING S.R.L., its subsidiaries or the members of its network, individually or jointly, be held responsible for direct or indirect damages, especially material damage, loss of data or programs, or financial loss resulting from access to or use of this website or any websites linked to it. The website content is presented without any warranty of any kind.

Art. 11 Contractual liability

The Customer is responsible for checking the final version of the Terms and Conditions whenever using the website.

Art. 12 Force majeure

Neither contracting party shall be liable for failure to perform on time and/or improper performance, in whole or in part, of any obligation incumbent upon it under this contract if the failure or improper performance of the respective obligation was caused by force majeure, as defined by law, for reasons independent of the parties.

The party invoking force majeure is obliged to notify the other party, within 5 (five) days, of the occurrence of the event and to take all possible measures to limit its consequences.

Art. 13 Applicable law

The contract shall be governed by and interpreted in accordance with Romanian law. Any dispute arising between the Merchant and the Customer in connection with the relations resulting from this Contract shall be resolved amicably, and, in case of failure, shall be submitted to the competent courts.

Art. 14 Updating the general conditions

SC INATECH PACKAGING S.R.L. reserves the right to modify and update access to the website and the General Conditions at any time. These modifications and updates are binding on the user, who must therefore regularly refer to this section in order to check the General Conditions in force.
